Parental consent is required under certain circumstances. Please refer to the “How to Submit” section in our FAQs for more details.

Parental Consent Reminder

Certain federal and state laws protect the sharing and disclosure of student and child personal information, including the Children’s Online Privacy Protection Act (“COPPA”), the Family Educational Rights and Privacy Act (“FERPA”) and New York Education Law § 2-d (“NY Ed. Law § 2-d”). In compliance with these laws, we require parental consent in the following situations:

For students under 13 years of age: A signed Parental Release Form is required.
For students ages 13 through 17:
- If school has a directory information policy that covers this personal information and parent/guardian has not opted out of the policy: No Parental Release Form is needed.
- If school does not have an applicable directory information policy or parent/guardian has opted out of the policy: A signed Parent Release Form is required. Teachers do not need to upload these forms; just keep them on file in a safe place.

With respect to every submission to be uploaded or authorized using this code, unless the student is 18 years of age or older, I attest that either:

(a) I have a signed Parental Consent Form on file in which the student’s parent or legal guardian consents to the disclosure of such student’s personal information to Tapestry of New York, or

(b) the student is at least 13 years of age and the student personal information shared in the submission is permissible under my school’s directory information policy and the eligible student/parent/legal guardian has not opted out of sharing directory information.

COPPA Consent for Children Under 13
Under federal law (the Children’s Online Privacy Protection Act or “COPPA”), if your child is under 13 years old, your permission is required for the collection, use and disclosure of their personal information.

Because Tapestry of New York includes certain personal information, including a child’s first name, last initial, school, and grade range, in connection with the display of their artwork on the online gallery, parental consent is required for submissions from children under 13.
